2. Website Information and Enquiries
Website content is provided for general information about our agency and services. Submitting an enquiry does not create a client relationship, guarantee acceptance of a project or constitute a binding service agreement. We may contact you using the details you provide to respond to your enquiry, discuss requirements or provide a requested proposal.
3. Scope of Services and Client Approvals
Services, deliverables, timelines, fees, campaign duration, reporting frequency and responsibilities will be described in the relevant quotation, proposal or written agreement. The client is responsible for reviewing and approving content, advertisements, designs, landing pages and other materials before publication or launch. Delays in providing information, access, feedback or approvals may affect delivery schedules.
4. Fees, Payments and Advertising Spend
Fees and payment milestones will be communicated in the applicable quotation or project agreement. Unless expressly included in writing, third-party advertising budgets, media spend, platform charges, taxes, domain and hosting fees, paid software, stock assets and other external costs are separate from SMS INFOTEK's professional service fees. Advertising spend is generally paid to the relevant advertising platform or as otherwise agreed in writing. Work may be paused for overdue payments, subject to the applicable agreement and law.
5. Advertising, Campaigns and Results
Digital advertising and marketing outcomes depend on many factors, including competition, audience behaviour, platform algorithms, budgets, creative quality, website performance, market conditions and client responsiveness. SMS INFOTEK will use reasonable professional efforts to deliver the agreed services, but does not guarantee specific rankings, leads, sales, reach, impressions, engagement, return on advertising spend or business results unless a specific written guarantee is expressly agreed. Advertising platforms may reject, restrict, suspend or change campaigns under their own policies.
6. Client Responsibilities
Clients must provide accurate information, lawful instructions, required approvals and necessary access to websites, social accounts, analytics and advertising accounts. Clients are responsible for ensuring that materials, claims, products, services, offers, trademarks, images, customer lists and other assets they supply may lawfully be used for the intended purpose. Clients must not ask SMS INFOTEK to publish unlawful, deceptive, infringing, discriminatory or otherwise prohibited material.
7. Intellectual Property
Each party retains ownership of materials it owned before a project. Unless otherwise agreed in writing, SMS INFOTEK retains ownership of its pre-existing tools, methods, templates, know-how and working processes. Ownership or permitted use of final, client-specific deliverables will be set out in the relevant project agreement and may be subject to full payment. Third-party fonts, stock media, software, platform assets and other licensed materials remain subject to their respective licence terms. No part of this website may be copied, republished or commercially exploited without permission, except as permitted by law.
8. Third-Party Platforms and Services
Our services may involve third-party platforms such as Google, Meta, Instagram, Facebook, YouTube, WhatsApp, hosting providers, analytics tools and email services. Where SMS INFOTEK provides messaging or campaign services, clients are responsible for ensuring that contact lists have been collected lawfully and that recipients have provided any consent required by applicable law and platform policies. We do not support unsolicited spam, purchased or unlawfully obtained contact lists, deceptive messages or attempts to bypass platform safeguards. Recipients should be given a clear way to opt out where required, and opt-out requests must be honoured. WhatsApp Business, email and other communication campaigns are subject to the applicable provider policies and technical limits.
10. Acceptable Website Use

Project suspension, cancellation, refunds, handover and termination arrangements will be governed by the relevant proposal or service agreement and applicable law.
